In order to obtain a conviction under the California Identity Theft Law covered under section 530.5
of the Penal Code, the prosecutor must prove all of the following:

  • A person willfully obtained personal identifying information of another person;
  • The information was obtained without authorization;
  • The information was used for any unlawful purpose, including obtaining credit, goods, services, or medical records in the victim's name and without the victim's consent.

A San Francisco man was sentenced to 90 months in federal prison for his role in an identity theft and fraudulent document and credit card-making operation. Two San Diego, California men were sentenced after their guilty pleas to federal identity theft charges. The men pleaded guilty to one count each of computer fraud, access device fraud, aggravated identity theft and one count of conspiracy to commit computer fraud.
